DISPUTE RESOLUTIONS

Dispute Resolution is an adjudicative process, where a third-party Neutral is retained to hear and consider the facts and/or positions presented to render an award or recommendation. This is by far the most customizable option for your project.

In this approach, presentations of issues, claims, positions, rebuttals, etc. are by the persons most knowledgeable and not the attorneys. We prefer to hear from you directly and while your attorney can be present they should not speak aloud or directly to the Neutrals.

What our Neutrals can do for your Dispute Resolution

  • Dispute Resolution Advisor (DRA)

    A SINGLE NEUTRAL

    Our Neutrals review your project’s issues as a lone advisor to the project. Typically they are engaged at the start of the project but can also be engaged ad hoc or mid-project as needed to facilitate dispute resolutions.

  • Dispute Resolution Board (DRB)

    WITH A BOARD CHAIRPERSON

    Our Neutrals participate as part of a three-person board that is typically engaged at the start of the project but can also be formed ad hoc or mid-project as needed to facilitate dispute resolution.

  • Dispute Resolution Board (DRB)

    BOARD CHAIRPERSON

    The Board is led by a Chairperson. This person has several additional responsibilities such as scheduling, communications, reports, billing, and logistics coordination.

  • Advisory Opinion (AO)

    SUMMARY JUDGEMENTs

    Our Neutrals review short (1-2 page) positions from each party and may hear informally from the parties, and then provide an Advisory Opinion (AO) based on the currently presented information.

    RESOLVE IT EARLY

    Our Neutrals engage with the project, using active listening and curiosity understand your emerging issues. They will lend their unique hands-on experience to seek the best outcome for the project before it becomes a claim or contentious item.
